Please read these Terms of Use ("Terms") carefully before using the Fleming Family Wellness website and patient portal (collectively, the "Services") operated by Fleming Family Wellness ("we," "us," or "our").

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not use our Services.

• A secure patient portal for established and registered patients, offering appointment management, secure messaging, records access, billing services, and intake forms.
• An AI-powered portal assistant for navigational and scheduling support only.

The Services are intended to support, not replace, your relationship with your healthcare provider. The Services do not constitute the practice of medicine and are not a substitute for professional medical advice, diagnosis, or treatment.

3. Patient Portal Eligibility and Account Security

To use the patient portal, you must:

• Be 18 years of age or older, or a legally authorized representative of a minor patient.
• Be a current or prospective patient of Fleming Family Wellness.
• Create and maintain a secure account with a unique email address and strong password.
• Maintain the confidentiality of your login credentials and not share them with others.

You are responsible for all activity that occurs under your account. If you believe your account has been accessed without authorization, contact us immediately at (555) 867-5309.

4. Important Medical Disclaimer

Medical Emergencies: If you believe you are experiencing a medical emergency, call 911 immediately or go to the nearest emergency room. Do not use the patient portal or website to communicate emergency situations.

5. AI Portal Assistant — Limitations and Disclosure

The patient portal includes an AI assistant feature. By using this feature, you acknowledge and agree that:

• The AI assistant is designed solely for navigation, scheduling guidance, and general billing questions.
• The AI assistant does not provide medical advice, clinical recommendations, diagnoses, or treatment plans of any kind.
• AI-generated responses are not reviewed by licensed clinical staff before delivery and may contain errors or inaccuracies.
• You will not rely on AI-generated responses for any healthcare decision.
• All AI interactions are logged and may be reviewed by authorized staff for quality assurance and safety purposes.
• We reserve the right to modify or discontinue AI features at any time.

6. Patient Portal Use Restrictions

You agree not to use the patient portal to:

• Communicate medical emergencies (call 911 instead).
• Submit false, misleading, or fraudulent information.
• Access or attempt to access another patient's records or account.
• Attempt to reverse engineer, scrape, or disrupt the portal or its underlying systems.
• Transmit malware, spam, or harmful content of any kind.
• Violate any applicable law or regulation.

7. Intellectual Property

All content on this website and within the Services, including text, graphics, logos, and software, is the property of Fleming Family Wellness or its content providers and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent. Your medical records remain your property; your right to access them is governed by applicable law and our Notice of Privacy Practices.

8. Third-Party Services

The Services may incorporate third-party services including cloud infrastructure (Amazon Web Services), authentication services (Amazon Cognito), and payment processing. Use of these services is subject to their respective terms of service and privacy policies. We are not responsible for the practices of third-party providers, though we require all vendors who access PHI to maintain HIPAA Business Associate Agreements.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Fleming Family Wellness and its providers, staff, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Services, including any reliance on information provided through the AI assistant.

Our total liability to you for any claims arising from your use of the Services shall not exceed the amounts, if any, you have paid to us for the specific service giving rise to the claim in the six months preceding the event.

10. Indemnification

You agree to indemnify and hold harmless Fleming Family Wellness and its officers, employees, and agents from and against any claims, damages, or expenses (including attorneys' fees) arising out of your violation of these Terms, your use of the Services, or your violation of any rights of another party.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. We will post updated Terms on this page with a revised "Last Updated" date. Material changes will be communicated through the patient portal or other appropriate means. Your continued use of the Services after any changes constitutes your acceptance of the revised Terms.

12. Termination

We reserve the right to terminate or suspend your access to the Services at any time, with or without cause, including for violations of these Terms. Termination of portal access does not affect your right to access your medical records as provided by law. You may request account deactivation by contacting our office.

13. Governing Law

These Terms are governed by the laws of the State of Illinois without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Services shall be subject to the exclusive jurisdiction of the courts located in Sangamon County, Illinois.
